1Purpose and publisher
These terms of use (the “Terms”) govern access to and use of the Sona mobile application, the sona-app.xyz website and related services (the “Service”).
The Service is published by BeBranded, a French simplified joint-stock company (SAS) with a share capital of €10,000, registered with the Bobigny Trade and Companies Register under number 984 530 212, with its registered office at 34 avenue Chanzy, 93250 Villemomble, France (“BeBranded” or “Sona”). The Service lists a city's cultural offering — exhibitions, shows, concerts — and lets you navigate between the venues, artists, companies and events that connect them.
2Acceptance of the Terms
Using the Service implies full acceptance of these Terms. By creating an account or using the Service, you acknowledge that you have read and accepted them.
If you use the Service on behalf of a cultural venue or organisation, you represent that you have authority to bind it.
3Access to the Service and free use
The Service is available free of charge, for both users and cultural venues, during the launch phase. BeBranded reserves the right to change this in the future, subject to prior notice to the users concerned.
Access requires a compatible device and an internet connection, the cost of which is yours. Some features (favourites, following venues or artists, notifications) require an account.
4Registration, account and minimum age
You may create an account with an email address and password, with a phone number (one-time code sent by SMS), or through Sign in with Apple or Google. You agree to provide accurate information and keep it up to date.
You are responsible for keeping your credentials confidential and for all activity carried out from your account. Notify us without delay at [email protected] in the event of unauthorised use.
The Service is not intended for people under 15. If you are between 15 and 18, you must use the Service with the consent of your legal guardian.
5Nature of the cultural information
Information about events and venues (dates, times, prices, cast, images) comes from cultural venues, their official websites and publicly accessible sources. It is provided for information only.
Despite the care taken in collecting and updating it, BeBranded does not warrant that it is exhaustive or permanently accurate. Before travelling, check the information on the official channels of the venue concerned.
Any venue, artist or rights holder may request the correction or removal of information concerning them at [email protected].
6No ticketing
Sona does not sell tickets and is not involved in any transaction. The “Book” button opens the official website of the venue or of its ticketing provider in your browser.
Any booking, payment or cancellation is exclusively between you and the venue or ticketing operator concerned, and is subject to their own terms. BeBranded is not a party to any such contract.
7User conduct
You agree to use the Service in accordance with the law and these Terms, without infringing the rights of third parties or the proper functioning of the Service.
The following are prohibited in particular: publishing unlawful, misleading, defamatory, hateful or public-order-infringing content; impersonating a venue, an artist or any person; automated extraction, copying or large-scale reuse of the Service's database; any attempt to compromise the security or integrity of the Service.
8Cultural venues: content and licence
Cultural venues holding a manager account are solely responsible for the content (events, descriptions, images, times, prices, links) they publish and warrant that they hold the rights required to distribute it, including for photographs and show visuals.
By publishing content, the venue grants BeBranded a free, non-exclusive, worldwide licence to reproduce, technically adapt (resize, crop) and display that content within the Service and its promotional materials, for the duration of its publication.
BeBranded may moderate, suspend or remove any content that is manifestly unlawful or non-compliant with these Terms, and may suspend the account concerned in the event of a serious or repeated breach.
9Intellectual property
The Sona brand, logo, application, interfaces, texts and database structure are protected by intellectual property law and remain the exclusive property of BeBranded. Any unauthorised reproduction, extraction or substantial reuse is prohibited.
The images, trademarks and content of events and venues remain the property of their respective owners.
10Personal data
The processing of personal data is described in our privacy policy, which forms an integral part of these Terms. You have rights of access, rectification, erasure, objection and portability, which you may exercise at [email protected].
11Availability and liability
BeBranded uses reasonable means to ensure the availability, security and accuracy of the Service, without any guarantee of freedom from error or interruption. The Service may be suspended for maintenance or technical upgrades.
BeBranded cannot be held liable for information published by cultural venues, for the cancellation, postponement or modification of an event, or for the content of third-party websites accessible from the Service.
Nothing in these Terms limits BeBranded's liability in the event of wilful misconduct, gross negligence or personal injury, nor deprives consumers of the statutory guarantees they enjoy.
12Term, account deletion and termination
These Terms apply for as long as you use the Service. You may delete your account at any time from the app settings or by writing to [email protected]: the associated data is then erased or anonymised as set out in the privacy policy.
BeBranded may suspend or terminate an account in the event of a breach of these Terms, after informing the user except in cases of manifest illegality or legal obligation.
13Changes to the Terms
BeBranded may amend these Terms, in particular to reflect legal or functional developments. Users are informed of any material change by any appropriate means; continued use of the Service constitutes acceptance of the version in force.
14Distribution by platforms
The application is distributed through Apple's App Store and Google Play. These platforms are not parties to these Terms and assume no obligation in respect of the Service. Use of the application also remains subject to the terms of the platform from which it was downloaded.
15Governing law, mediation and disputes
These Terms are governed by French law.
In the event of a dispute, first send a complaint to [email protected]. Failing a solution within thirty days, a consumer may refer the matter free of charge to a consumer mediator or to the European online dispute resolution platform.
Failing an amicable resolution, any dispute falls under the jurisdiction of the French courts, without prejudice to the protective rules applicable to consumers, who may bring proceedings before the court of their place of residence.
